Having a home usually means the last word about what happens in your yard. But one owner of Georgia’s home says she woke up for a sound that made her heart fall – strangers in her yard, breaking into her tree.

In the Reddit post title “[Georgia, USA] Hoa tried to cut my tree, “she explained that her home was built before the surrounding subdivision and that it was never a part of the HOA. However, one morning the crew arrived without notice and began to cut into her healthy sweet gum tree.

“Yesterday morning, I woke up in a group of men in my yard, trying to cut a healthy sweet gum tree,” she wrote. “The man cutting the tree said he was asked to fall a tree because it was uncomfortable for a neighbor because he dropped sweet gum seeds in his yard.”

According to her post, no one has ever asked her to cut or remove the tree. “No one ever asked us to do something with the tree,” she added, excited that someone – Hoa or otherwise – thought they had the right to touch it.

When she ordered the crew to stop, they ignored her before she called the police. Until then, the damage was caused. “They cut the branches back into the trunk, but left the very top and bottom of the branches. Now it looks like a shit and has dead, broken and cut branches that hang from it,” she wrote.

This post quickly drew the attention of other Reddit users, many offer tips and outrage in the same way. “You probably have a nice lawsuit against your neighbor and a tree company,” one person said. Another added: “They not only illegally cut your tree, but also illegally violated your property without your permission.” Several offered her to visit the Tree Law to get other actions, or hire a certified arborist to assess the damage.

“An arborist can determine the value of a tree,” explained one consumer, “and you can use it to help your lawyer calculate the damage.”

In her answers, the homeowner said she had already talked to several lawyers, but no one had agreed to take her case. She is now stuck with a meat tree and a possible removal account she has never asked for.

At the time of publication, she was also worried about the next few months – that strong winds or severe storms could capture the weakened branches that workers have left, thus at risk of her property.

Although Reddit’s legal users have offered a lot of condolences, the case also raised a broader question about too much and responsibility. If her home is not actually part of the HOA, the association does not have its own jurisdiction. Any actions they have taken or hired something else can be legally regarded as a criminal or destruction of property.

If she had actually had a HOA, the standard procedure would have required a written notice, hearing, or at least some communication before the crew built her leg on its lawn. However, as a non -member, it has never been bound by their rules, and their government ends with its own lines.

So far, she has been damaged by a tree, at the expense she did not have permission, and the constant feeling that her rights as homeowners have been cut as carelessly as its branches.
